Overview

These Terms of Service (“Terms”) govern your use of volunah.com and purchases through our online store. “Volunah,” “we,” “us,” and “our” refer to Volunah LLC doing business as Volunah. Our website, online store, content, and related features are collectively the “Services.” Our store is powered by Shopify.

By using the Services or placing an order, you agree to these Terms. If you do not agree, please do not use the Services. Our Refund Policy and Shipping Policy form part of the terms applicable to your purchase. Our Privacy Policy explains how personal information is handled; accepting these Terms does not replace any separate privacy or marketing consent required by law.

Nothing in these Terms excludes or limits consumer rights, warranties, or remedies that cannot lawfully be excluded or limited.

These Terms apply to purchases made through volunah.com. Purchases through another retailer or marketplace are subject to that seller’s applicable transaction terms. Event participation and any separate membership program require their own terms where offered.

1. Eligibility and Account Information

To place an order, you must be legally able to enter into a binding agreement or have a parent or legal guardian place the order on your behalf.

You may purchase without creating an account. If you use an account, keep your login information secure and contact us if you suspect unauthorized access.

You agree to provide accurate and current contact, billing, payment, and shipping information. You must be authorized to use the payment method submitted with your order.

You are responsible for activity you authorize through your account. You must not share access for fraudulent purposes or use another person’s account without permission. This does not make you responsible for unauthorized activity caused by a security failure for which we are legally responsible.

2. Products, Sizing, and Availability

Volunah sells apparel and related products. Product pages describe the available styles, colors, materials, sizing, and other relevant details. Please review this information and any available size guide before ordering. Fit can vary by style and individual body measurements.

We aim to represent products accurately. Screen settings and lighting may affect how colors appear online. This does not excuse a product that is defective or materially different from its description.

Follow the care instructions supplied with your garment. Ordinary wear and tear or damage caused by improper care does not, by itself, qualify an item for a standard return. This does not limit rights relating to manufacturing defects or other protections provided by law.

Product availability and purchase quantities may be limited. We may update or discontinue products, but changes to a listing do not retroactively alter the description or terms applicable to an accepted order.

Adding an item to a cart does not reserve inventory. Any disclosed limits apply across orders where we reasonably determine they were placed to circumvent the same limit. A restock notification or announcement does not guarantee availability.

3. Orders and Acceptance

Placing an order is an offer to purchase the items selected. An automated order receipt acknowledges that we received your order. Acceptance occurs when we send a shipping confirmation or otherwise expressly confirm acceptance.

Before acceptance, we may decline an order for a legitimate reason, such as unavailable inventory, an unresolved payment issue, a material listing error, suspected fraud, or an attempt to bypass disclosed quantity limits. After acceptance, we may cancel only where permitted by law or agreed with you. We will notify you using the contact information provided and promptly refund any payment collected for items we cancel or cannot supply. If we cancel an entire order, we will refund all amounts collected for that order, including shipping and applicable taxes.

We will not substitute a materially different product or increase the price of an existing order without your agreement.

We may request information reasonably necessary to verify an order or payment before fulfillment. If verification cannot be completed, we may decline the order, subject to the cancellation and refund protections above. Do not send full payment card details or passwords through ordinary email.

4. Prices, Payments, and Promotions

Prices and the applicable currency are displayed on the store or at checkout. Applicable taxes and shipping charges are shown before you complete your purchase. You authorize us and our payment providers to process the total you approve at checkout.

Prices and promotions may change for future purchases. A later price change does not change the price of an accepted order.

Promotions may have eligibility requirements, expiration dates, quantity limits, or other conditions disclosed with the offer. Those conditions govern the promotion if they conflict with these Terms. Discount codes may be combined only when the offer allows it. Promotional discounts apply to eligible merchandise only and do not reduce shipping charges unless expressly stated in the offer.

Unless the offer states otherwise, a promotion applies only to eligible purchases made during its stated period and does not create a right to a retroactive price adjustment. For a returned item purchased at a discount, the refund is based on the amount actually paid for that item. We will not impose an undisclosed penalty or retroactively remove a discount from retained items.

If we discover a material pricing or listing error affecting your order, we will contact you to resolve it. If the order is canceled, we will refund the amount collected for the canceled items and any associated charges that should be refunded. We will not charge a higher amount without your permission.

Payment disputes. If a charge appears incorrect, you may contact us for help. You retain the right to dispute a charge through your bank or payment provider without contacting us first. We may provide relevant transaction, delivery, and correspondence records to the payment provider, consistent with our Privacy Policy. If a refund and a payment dispute concern the same amount, we will coordinate with the provider to avoid duplicate reimbursement, without delaying any refund beyond a legally required deadline. Knowingly false payment or refund claims are prohibited; a good-faith dispute is not a violation of these Terms.

5. Order Changes and Cancellations

To request a change or cancellation, email hello@volunah.com as soon as possible with your order number. We will try to accommodate requests before fulfillment, but changes and cancellations are not guaranteed once processing or shipment has begun.

If an order can no longer be canceled, you may request a return under our Returns & Refunds Policy. This section does not limit any cancellation rights provided by applicable law, including rights relating to shipping delays.

6. Shipping and Delivery

We currently ship within the United States only. Our Shipping Policy describes processing times, available methods, rates, free-shipping eligibility, and estimated transit times. Your available shipping options and final charge are displayed at checkout before purchase. Express shipping affects transit time only and does not shorten processing. Delivery estimates are not guarantees unless expressly described as guaranteed.

We will ship within the timeframe stated for your order. If no shipping timeframe is stated, we will comply with the timeframe required by applicable law. If we cannot ship on time, we will notify you and provide any required opportunity to agree to a revised shipping date or cancel for a prompt refund.

Please check your shipping address before ordering. If you discover an error, contact us promptly. We may be unable to redirect an order after shipment. Any additional charge for reshipment due to an address you supplied incorrectly will be explained and agreed with you before reshipment.

If your package is missing, damaged, or marked delivered but has not arrived, contact hello@volunah.com. We will review the issue and work with the carrier as appropriate. Handing a package to a carrier does not eliminate our obligations to you under applicable law.

We may request reasonable information, such as address confirmation or photographs of damaged packaging when available, to investigate. A carrier’s delivery scan is evidence we may consider, not automatic proof that every delivery dispute is invalid. We will communicate the outcome and any replacement or refund available under the circumstances and applicable law.

7. Returns, Exchanges, and Refunds

Our Returns & Refunds Policy provides the full return process. The following summarizes our standard terms:

- Request a return within 30 days of delivery by emailing hello@volunah.com with your order number or other proof of purchase.

- Eligible items must be unworn, unwashed, and in their original condition, with original tags attached. Trying an item on to check fit is permitted.

- Contact us for approval and return instructions before sending an item back.

- Customers pay return shipping for standard returns, including changes of mind and sizing preferences. Original shipping charges are not refunded for those returns.

- Volunah covers necessary return shipping for incorrect items or items that arrive damaged or defective.

- We inspect returns and issue approved refunds within 10 business days of receiving the returned item. Refunds go to the original payment method for the amount paid for the returned item, including applicable tax. Your payment provider may require additional time to post the refund.

- We do not offer direct exchanges. Return an eligible item for a refund and place a new order, subject to availability.

- Items clearly marked final sale before purchase are excluded from standard returns and exchanges. A discount alone does not make an item final sale.

Return assessment. Initial return approval authorizes shipment for inspection; it does not guarantee a refund if the returned item fails the eligibility requirements. Return the correct item with its original tags and package it securely. We may request reasonable information to match the return to your purchase. If we decline a refund, we will explain the specific reason and contact you about the item’s return. Any proposed shipping charge will be disclosed for your agreement first. We will not automatically treat a disputed return as abandoned.

A return request sent within 30 days of delivery remains timely if our response arrives after that window. Our own processing delay will not disqualify it. Business days mean Monday through Friday, excluding U.S. federal holidays. The 10-business-day processing period begins when we receive the returned item, not when we finish inspecting it; a shorter legally required deadline takes priority.

Final-sale restrictions and standard return conditions do not limit rights relating to defective, damaged, incorrect, or misdescribed goods under applicable law.

If this summary conflicts with the Returns & Refunds Policy presented when you purchased, that policy governs the return process, subject to your mandatory legal rights. Later policy changes do not reduce the return rights applicable to an earlier purchase.

8. Privacy and Communications

Our Privacy Policy, available on the store, explains how we and relevant service providers collect, use, and disclose personal information and describes available privacy choices.

We use email to communicate about orders and customer service. Promotional emails are subject to your marketing preferences and applicable law. You may unsubscribe using the link in those emails. Unsubscribing does not prevent necessary order or service communications.

Creating an account, making a purchase, or agreeing to these Terms does not by itself provide consent to marketing text messages.

9. Relationship with Shopify

Volunah is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Volunah. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Volunah, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Volunah.

The mandatory consumer-rights protections stated in these Terms also apply to this section. Information about Shopify’s processing of personal information is available in the Shopify Consumer Privacy Policy.

10. Intellectual Property

The Volunah name, logos, original graphics, product photography, text, videos, and other brand materials are owned by Volunah or used with permission from their owners. Applicable intellectual property rights remain with those owners.

You may browse the store and share links to our publicly available pages for personal, lawful purposes. Except as permitted by law or with our written permission, you may not reproduce our original graphics on merchandise, use our branding to imply an affiliation or endorsement, or commercially distribute our website content.

Third-party names and trademarks, including Shopify’s, belong to their respective owners. Nothing in these Terms transfers ownership of them to you.

Where protected by applicable law, you may not copy, adapt, or commission reproductions of our original artwork, logos, or other protected design elements for commercial products without permission. You may not remove ownership notices or use our content to create a counterfeit store or misleading affiliation. These restrictions are subject to fair use and other lawful exceptions and do not claim exclusive rights over unprotected clothing styles or functional features.

To report suspected infringement, email hello@volunah.com with the material’s location, an explanation of your rights, and contact information. We may pursue remedies available under applicable law for infringement or impersonation.

11. Reviews and Customer Content

If you submit a review or other content for publication on our store, you retain ownership of that content. You grant Volunah a nonexclusive, worldwide, royalty-free license to host, reproduce, and display it in connection with the relevant product and the operation of our store. We may make formatting changes that do not misrepresent your meaning and permit providers operating the store to process the content for those purposes.

This permission does not apply to private customer-service messages or automatically authorize use of your photos or likeness in paid advertisements. We will seek separate permission where appropriate for those uses.

You must have the rights needed to submit the content. Reviews should reflect your honest experience, and any compensation or incentive should be disclosed.

We may remove spam, unlawful content, private information posted without permission, or material that infringes another person’s rights. We do not prohibit or penalize honest negative reviews or require you to transfer ownership of a review.

12. Acceptable Use

You may not use the Services to:

- Commit fraud, submit unauthorized payments, or impersonate another person.

- Infringe intellectual property or privacy rights.

- Threaten or unlawfully harass other people.

- Upload malicious code, interfere with the website, or attempt unauthorized access.

- Collect other customers’ personal information without authorization.

- Manipulate reviews, orders, promotions, or purchase limits through deceptive activity.

- Use automated tools to bypass security controls, evade access restrictions, or materially disrupt the Services.

These restrictions do not prohibit lawful reviews, accessibility tools, or ordinary browsing and shopping.

You must not submit a counterfeit item, a different item, or fabricated evidence as part of a return or delivery claim. We may document suspected fraud and provide relevant records to payment providers or authorities where appropriate and lawful. Requesting a legitimate return, reporting a defect, or exercising a statutory right is not abuse.

13. Third-Party Services and Links

Our store may include links or optional features operated by third parties. Their own terms and privacy policies may apply to their services. A link does not necessarily mean we endorse the third party or its content.

We do not control independent third-party websites. However, using providers to process payments, ship orders, or support our store does not remove obligations we owe you as the seller.

14. Website Availability and Warranties

We aim to keep the Services accurate and available, but cannot promise uninterrupted access or that the website will always be free of errors. We may temporarily suspend features for maintenance, security, or operational reasons.

To the extent permitted by law, the website and its optional features are provided “as is” and “as available,” without additional warranties beyond those expressly stated.

This website disclaimer does not disclaim warranties that apply to products by law, excuse materially inaccurate product descriptions, or reduce our obligations under an accepted order or our Returns & Refunds Policy.

15. Limitation of Liability

To the extent permitted by applicable law, Volunah will not be liable for indirect or consequential losses arising from use of the Services, such as lost business profits or business opportunities.

Nothing in these Terms excludes or limits liability for fraud, willful misconduct, gross negligence, personal injury where liability cannot be limited, or any other liability that applicable law does not allow us to exclude or limit. Nothing limits any refund, warranty, or other remedy you are legally entitled to receive.

Where a limitation is not permitted in your jurisdiction, it does not apply to you.

Responsibility for third-party claims. To the extent permitted by law, you agree to reimburse Volunah for reasonable, documented losses and legal costs resulting from a third-party claim directly caused by your fraud, willful unlawful misuse of the Services, or knowing infringement of that party’s intellectual property rights through content you submit. This obligation applies only to the extent of your responsibility and does not cover Volunah’s own wrongdoing, ordinary shopping or returns, honest reviews, or good-faith payment disputes. We will promptly notify you of the claim and allow reasonable participation in its defense. We will not agree to a settlement that imposes a payment or other obligation on you without your written consent. This provision does not create an automatic duty to fund our defense before responsibility is established.

16. Suspension or Termination

We may restrict or suspend access when reasonably necessary to address fraud, security risks, unlawful conduct, or a material violation of these Terms. Where appropriate and lawful, we will provide notice and an opportunity to resolve the issue.

Suspending an account does not eliminate your rights relating to paid orders, eligible returns, refunds, or privacy requests. Provisions intended to remain effective after access ends, including intellectual property and applicable liability provisions, continue to apply.

17. Governing Law and Disputes

These Terms are governed by California law and applicable United States federal law, without depriving you of mandatory consumer protections that apply where you live.

If a concern arises, please contact hello@volunah.com so we can try to resolve it. Contacting us is not a condition of exercising your legal rights. Disputes may be brought before a court with lawful jurisdiction. These Terms do not require binding arbitration or waive your right to bring a claim in small claims court where eligible.

18. General Terms

If a provision is found unenforceable, the remaining provisions continue to apply to the extent permitted by law. Our failure to enforce a provision on one occasion does not waive the right to enforce it later.

These Terms, the Refund Policy, the Shipping Policy, and any specific purchase or promotion terms disclosed before the transaction form the agreement governing that transaction. If these Terms conflict with the applicable Refund Policy on return procedures or the applicable Shipping Policy on shipping arrangements, the policy addressing that subject controls. Our Privacy Policy controls descriptions of our handling of personal information. Nothing overrides an express product representation or nonwaivable consumer protection. The versions applicable when an order was placed continue to govern that order as described in Section 19.

If the business is transferred, any successor assuming these Terms must honor existing customer obligations. Such a transfer does not reduce your rights under accepted orders.

19. Changes to These Terms

We may update these Terms as our store or practices change. We will post the revised Terms and update the date above, with additional notice or consent where required by law.

Updates apply prospectively. The terms applicable when an order was placed continue to govern that order unless you agree to a change or applicable law requires otherwise.
